OUR PRIVACY POLICY, IN SUMMARY
|
WHO ARE WE? |
We are NIFTY LASH S.L., owners of the "BEAUTY LASH" brand, and we process your personal data as data controllers. This means that we are responsible for collecting your data, using it for the purposes indicated below, and protecting it. |
|
FOR WHAT PURPOSES DO WE USE YOUR DATA? |
We will use the data you have provided us for several purposes, such as to answer your inquiries, either through the contact form or through other channels enabled on our website, to register you as a user, to manage your purchases and orders in our online store, to manage your subscription to our newsletter, and if you wish, to send you our personalized commercial communications. |
|
WHY DO WE USE THEM? |
The legal basis that allows us to process your data varies depending on the purpose of each processing. For example, when you buy or contract our products or services, we will process your data based on the execution of the contract that binds us, as well as to comply with our legal obligations. If you register as a user, or if you make any type of inquiry, it will be your consent that legitimizes us to process your data, and in some cases also our legitimate interest in responding to your requests. Likewise, if we send you our newsletter or other commercial communications about our products and services, we will do so because we will have previously obtained your express consent. |
|
HOW LONG WILL WE KEEP YOUR DATA? |
As a general rule, we will only keep your data for the minimum essential time, i.e., as long as they remain relevant in relation to the purposes for which they were collected. For example, the data you provide us through the contact form will be kept until we have resolved your query or request, the data we use to register you as a user will be kept as long as you do not unsubscribe, and the data obtained during the purchase process will be kept until you have received the product, without prejudice to the fact that all these periods may be extended as long as necessary to comply with our legal obligations. Once these periods have ended, we will proceed to delete or anonymize the personal data. |
|
WHO DO WE SHARE THEM WITH? |
We will share your data with service providers or external collaborators who perform specific functions for NIFTY LASH and who are necessary for us to provide our services to you (logistics companies, financial entities responsible for the payment gateway, technology service providers, etc.). All these companies will process your data following the instructions and agreements signed with NIFTY LASH. |
|
WHAT ARE YOUR RIGHTS? |
You have the right to obtain confirmation as to whether NIFTY LASH is processing personal data concerning you. If so, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, to request its deletion when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, you may object to the processing of your data or request its restriction. You also have the right to data portability, not to be subject to a decision based solely on automated processing, to withdraw your consent, and to file a complaint with the supervisory authority. We have forms available for you to exercise all the aforementioned rights. |

Likewise, you should know that, in compliance with the LSSI, we will not send you commercial communications without identifying them as such and without your prior consent. For these purposes, any information we send you will not be considered commercial communication as long as its purpose is the maintenance of a previous contractual relationship or the response to your requests or inquiries, as well as any information related to these or directly derived from said relationship. In each commercial communication we send you, we will offer you the possibility to unsubscribe so as not to receive more communications of that type.
Furthermore, the purposes for which we may process your personal data, as the case may be, are those indicated below:

The personal data you provide us throughout the purchase process on our online platform will be used to process, ship, and invoice purchased products and/or services rendered, to inform you about the tracking and delivery of your order, to manage potential returns and refunds, and to provide after-sales service.
We will also use them to comply with our legal obligations and legitimate interests, including the adoption of anti-fraud measures during contracting, measures derived from anti-money laundering regulations, and the management of unpaid invoices.
Likewise, we will process your data to maintain a history of our business relationships with you, to keep our accounting records, and to comply with our administrative and tax obligations.
Finally, we may process your data to conduct statistical analyses on the use of our online store, in order to optimize our content and improve user experience, to verify the minimum age for website use, and to create commercial profiles of our users in order to offer them—always with their consent—products and content more suited to their tastes and preferences.
Commercial communications (advertising)
In some of our forms, such as contact, registration, or purchase process forms, we include a second box that you can voluntarily check. If you don't check it, nothing happens; we will only use your data for the specific purposes of the form in question. If you have chosen to follow us on these social networks, content or information related to our products and services that we believe may be of interest to you may appear on your wall or profile.

However, you must bear in mind that we can only provide you with the services you request or give you access to certain functionalities if you provide us with some data that we consider necessary for such purposes, and which you can clearly identify in our forms because they are marked with an asterisk (*).
If you do not provide us with these required data, we probably will not be able to provide you with the requested services or we may have to provide them to you incompletely. For example, if you submit a request through our contact form, register as a user, or subscribe to our newsletter, you must at least provide us with your name and email address, otherwise we will not be able to respond to your query, create your personal account, or send you the newsletter, respectively.
In any case, your consent must be free, specific, informed, and unequivocal, and you must grant it to us through a positive and affirmative action, without any pressure and knowing what you are consenting to. This is why at NIFTY LASH we advocate for maximum transparency, and when requesting your consent through the corresponding forms, we will include a summary with basic information on data protection, a link to this Privacy Policy, and a box that you must explicitly check to consent to the processing in question. We recommend that you read all this information before giving your consent to each type of processing. We will keep a record of all consents you have given in this regard.
Is it possible to revoke your consent?
Of course. In cases where you have authorized us to process your personal information, you may revoke your consent at any time by contacting us and specifically indicating for which processing or purposes you wish to revoke consent. You can do so by writing to our postal address, through the contact form on our website, or by email to info@beautylash.es. We may ask you for a copy of your ID to properly identify you. Please note that the revocation of your consent does not affect the legality of data processing subject to your consent that we carried out before such revocation, nor does it affect data processing that we may carry out on other legal bases, such as a legitimate interest, the performance of a contract, or compliance with a legal obligation.
RECIPIENTS
To which recipients will your data be communicated?
All the data you have provided us will be processed by NIFTY LASH with the utmost confidentiality. Occasionally, to fulfill the purposes indicated in this Privacy Policy, it is necessary for us to grant access to your personal data to other service providers who support us in the services we offer you. These are trusted third parties who will only have access to your data with the ultimate purpose of allowing us to provide you with the requested services under the best conditions.
When appropriate, and always in accordance with current legislation, we may exchange your personal data with the following categories of recipients:
- With service providers who perform specific functions for NIFTY LASH. This category includes, for example, the following:
- Transport or logistics companies that manage the shipment of orders to our customers, as well as exchanges and returns;

- Facebook Messenger subscriber management companies
NIFTY LASH has signed the corresponding data processing agreement with each of the external providers to whom we communicate personal data of our customers and users, so that they can only process them according to our instructions and for strictly necessary purposes.
In the event that, in order to provide you with our services, it is necessary to transfer your data to companies outside the European Economic Area (EEA), we will only work with companies that offer sufficient privacy protection in accordance with European legislation, such as, for example, service providers located in the United States or in other countries that have adhered to the "Privacy Shield" (www.privacyshield.gov), or companies with whom we have signed standard contractual clauses approved by the European Commission.
- With public administrations or public and private entities such as judicial bodies, tax authorities, police forces, fraud prevention and debt collection agencies, etc., in the event that by legal imperative or by our legitimate interests we are obliged to share certain information with them (for example, in case of litigation or in response to a request from a tax authority).
Will your data be transferred to third countries?
We will only communicate your data to recipients located in countries outside the European Economic Area (the countries of the European Union plus Liechtenstein, Iceland, and Norway) in the event that it is strictly necessary to be able to provide you with the requested or contracted services, for example when some of our providers mentioned in the previous section are located in third countries.
In these cases, all international data transfers will be carried out in strict compliance with all guarantees required by European legislation. That is, we will only communicate them to providers that adhere to the Privacy Shield, or through the use and signing of standard contractual clauses approved by the European Commission.
RIGHTS
What are your rights when you provide us with your data?
First, you have the right to obtain confirmation as to whether or not NIFTY LASH is processing personal data concerning you. And if we are processing your personal data, you have the following rights:
- Right of access: You have the right to access your personal data. If we are processing your data, you can ask us for the following information: what that data is; for what purposes we are processing it; possible communications, transfers or transfers of your data to third parties; expected retention period; your right to ask us for the rectification or deletion of your personal data or the restriction of its processing, or to object to such processing; the right to lodge a complaint with the supervisory authority; in the event that we have not obtained the personal data from you, any available information about its origin; the existence of automated decisions, including profiling, and significant information about the logic applied, as well as the importance and the foreseen consequences of such processing for you.
- Right to rectification: You have the right to obtain the rectification of inaccurate or incomplete personal data concerning you, for example, in case of errors, misspellings, changes in the collected data, etc. If we have shared your personal data with third parties, we will urge them to rectify it as you have indicated to us, unless this is impossible or involves a disproportionate effort. If applicable, we will also inform you to which third parties we have provided your inaccurate or incomplete personal data.
- Right to erasure ("right to be forgotten"): Under certain circumstances, you have the right to request that we erase or permanently delete your personal data when, for example, it is no longer relevant or necessary in relation to the purposes for which it was collected or otherwise processed, when you withdraw the consent on which the processing of your data is based (unless there is another legal basis for its processing), when you have objected to the processing of your data and other legitimate reasons for the processing do not prevail, etc.
- Right to object: You can object at any time, on grounds relating to your particular situation, to the processing of your personal data based on the satisfaction of our legitimate interests. In these cases, we will accede to your request to object and stop processing your personal data, unless there are compelling legitimate grounds for the processing that override the interests, rights and freedoms you have adduced, or for the establishment, exercise or defense of legal claims.
- Right not to be subject to automated individual decision-making: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This right will be excepted in cases where you have given us your explicit consent or where such a decision is necessary for entering into or performing a contract with you.
- Right to data portability: This is an advanced form of the right of access and means that you can ask us to send you a copy of your data in a structured, commonly used and machine-readable format (e.g., on a data CD). You can exercise this right in three cases: (i) when processing is carried out by automated means, i.e., without human intervention; (ii) when processing is based on your prior consent or on a contract; (iii) when you request it regarding data you have provided to us and that concerns you, including data derived from your own activity. The right to portability also implies that you can ask us to send your personal data to another controller on your behalf, without us having to send it to you first, provided that this is technically possible.
- Right to restriction of processing: You can ask us not to apply the processing operations that would correspond to your personal data in each case. In other words, we can only continue to store them, but we cannot perform any other processing activity until certain circumstances arise. For example, you can ask us to limit your data when you have exercised your rights of rectification or objection (while we are verifying the accuracy of your data or our legitimate reasons for processing it), or when your data should be deleted but you prefer us to limit the processing instead of deleting it completely. When the processing of your personal data has been limited, we can only process it (unless it is for its preservation) with your prior consent or for the formulation, exercise or defense of claims.
- Right to withdraw consent given: If you have given consent for a specific purpose, such as authorizing us to send you advertising about our products and services, you have the right to withdraw that consent at any time, without affecting the legality of the processing based on consent prior to its withdrawal.
- Right to complain to the Supervisory Authority: If you believe that your rights have been violated and that the processing of your personal data is contrary to the provisions of the General Data Protection Regulation, you have the right to file a complaint with the supervisory authority of your country, without prejudice to any other administrative appeal or judicial action you may file. In Spain, you can exercise this right by contacting the following supervisory authority:
Name: Agencia Española de Protección de Datos
Postal address: C/ Jorge Juan, 6. 28001, Madrid (Spain)
Telephone(s): +34 901 100 099 / +34 912 663 517
Website: www.agpd.es
If you reside outside of Spain, you can also contact the competent data protection authority in your country.
How can you exercise your rights?
We have forms available to you so that you can exercise all your rights mentioned above, quickly, free of charge and easily. You just have to request the form in question and return it to us completed via our email address info@beautylash.es, attaching a copy of your national identity document. Once your request is received, you will receive our response within a maximum of one month.

We apply appropriate technical and organizational measures to ensure a level of security appropriate to the risk, taking into account the risks posed by data processing as a result of the possible accidental or unlawful destruction, loss or alteration of personal data transmitted, stored or otherwise processed, or the unauthorized communication of or access to such data.
Our website is stored on secure servers protected against the most common types of attacks. Notwithstanding the foregoing, technical security in an environment like the Internet is not impregnable, and malicious actions by third parties may occur, although NIFTY LASH employs all means at its disposal to prevent such actions.

In fact, cookies facilitate the use and navigation of a website and are essential for the operation of the internet, thanks to the innumerable advantages they provide in the provision of interactive services, such as when they are used to manage your user session (reducing the number of times you have to enter your password), to improve the services offered, or to adapt the content of a website to your preferences.
Generally, the user can check or modify the type of cookies they accept through their browser settings, as we will show later. You decide whether or not to allow cookies, but if you decide not to allow them, you must block them in your browser.
Types of cookies and purposes of use
Depending on their origin, cookies can be first-party or third-party, and depending on the time they remain active on the user's terminal equipment, we can distinguish between session cookies and persistent cookies.
According to their purpose, we can talk about technical cookies, personalization cookies, analytical cookies, advertising cookies, behavioral advertising cookies, or external social media cookies.
What types of cookies does this website use?
The websites www.beautylash.es and www.beautylashacademy.com use first-party and third-party cookies, and specifically the following:

They allow user registration and authentication, the start and maintenance of the session when browsing the page, the contracting of a product or service, the configuration of language preferences, and security protection. These cookies are essential for the operation of the website, and their deactivation by blocking cookies in the browser options may prevent some of the website's functionalities from working correctly.
- Advertising and behavioral advertising cookies: We use these to manage as effectively as possible the advertising spaces that may exist on our website, adapting the content of the advertisement to the content of the service requested or to the use made by the user of the website. To do this, we can analyze your internet browsing habits and show you advertising related to your browsing profile. To learn more about behavioral advertising or manage your preferences, you can visit http://www.youronlinechoices.eu.
- Analytics cookies: we use Google Analytics cookies to analyze user visits and activity during their browsing time. Google Analytics cookies provide statistical information related to website visits (unique visitors, number of page views, average visit duration, bounces, new visits, frequency and recent visits, interactions, pages visited, etc.), demographic data (language, city, country/region), system (browser, operating system, internet access provider, etc.), source/medium. Google Analytics does not provide us with information about the user's actual IP address, so the information obtained through cookies is completely anonymous, and can in no case be associated with a specific and identified user. You can find more information at the following link: https://developers.google.com/analytics/devguides/collection/analyticsjs/cookie-usage
- External social media cookies: The NIFTY LASH website includes social media buttons (Twitter, Facebook, Pinterest and Google+) that allow users to share content of interest with members of their social circle. This type of cookie prevents the user from having to re-enter their data to share such content. These buttons do not have access to the data entered by users when sharing certain content on a social network.
