|
WHO ARE WE? |
We are NIFTY LASH S.L., owners of the brand “BEAUTY LASH”, and we process your personal data as Data Controllers. This means we are responsible for collecting your data, using it for the purposes outlined below, and protecting it. |
|
WHAT DO WE USE YOUR DATA FOR? |
We will use the data you have provided for various purposes, such as to respond to your queries (whether through the contact form or other channels on our website), to register you as a user, to manage your purchases and orders in our online store, to manage your subscription to our newsletter, and if you wish, to send you our personalized commercial communications. |
|
WHY DO WE USE THEM? |
The legal basis that allows us to process your data varies depending on the purpose of each treatment. For example, when you purchase or contract our products or services, we will process your data based on the performance of the contract that binds us, as well as to comply with our legal obligations. If you register as a user, or if you ask us any type of question, it will be your consent that legitimizes us to process your data, and in some cases also our legitimate interest in responding to your requests. Likewise, if we send you our newsletter or other commercial communications about our products and services, we will do so because we have previously obtained your express consent. |
|
HOW LONG WILL WE KEEP YOUR DATA? |
As a general rule, we will keep your data only for the minimum time necessary; that is, as long as it remains relevant to the purposes for which it was collected. For example, data provided through the contact form will be kept until we have resolved your query or request; data used to register you as a user will be kept as long as you do not unsubscribe; and data obtained during the purchase process will be kept until you have received the product, notwithstanding that all these periods may be extended as necessary to comply with our legal obligations. Once these periods have ended, we will proceed to delete or anonymize personal data. |
|
WHO DO WE SHARE IT WITH? |
We will share your data with service providers or external collaborators who perform specific functions for NIFTY LASH and are necessary for us to provide our services to you (logistics companies, financial entities responsible for payment gateways, technology service providers, etc.). All these companies will process your data following instructions and agreements signed with NIFTY LASH. |
|
WHAT ARE YOUR RIGHTS? |
You have the right to obtain confirmation as to whether NIFTY LASH is processing personal data concerning you. If so, you have the right to access your personal data, as well as to request the rectification of inaccurate data or, where appropriate, request its erasure when, among other reasons, the data is no longer necessary for the purposes for which it was collected. In certain circumstances, you may object to the processing of your data or request its restriction. You also have the right to data portability, not to be subject to a decision based solely on automated processing, to withdraw your consent, and to lodge a complaint with the supervisory authority. We have forms available for you to exercise all the aforementioned rights. |

Likewise, you should know that, in compliance with the LSSI, we will not send you commercial communications without identifying them as such and without your prior consent. For these purposes, information sent to you will not be considered a commercial communication provided its purpose is the maintenance of a prior contractual relationship or the response to your requests or queries, as well as any information related to these or deriving directly from said relationship. In every commercial communication we send you, we will offer you the possibility to unsubscribe to stop receiving such communications.
Otherwise, the purposes for which we may process your personal data, as the case may be, are indicated below:

We will also use them to comply with our legal obligations and our legitimate interests, including the adoption of anti-fraud measures during contracting, measures derived from anti-money laundering regulations, and the management of unpaid invoices. Likewise, we will process your data to maintain a history of our commercial relations with you, to keep our accounting, and to comply with our administrative and tax obligations. Finally, we may process your data to perform statistical analysis on the use of our online store, in order to optimize our content and improve the user experience, to verify the minimum age for use of the website, and to create commercial profiles of our users in order to offer them —always with their consent— products and content more adjusted to their tastes and preferences. |

In some of our forms, such as contact forms, registration forms, or the purchase process, we include a second box that you can check voluntarily. We will process the information we obtain through cookies to allow navigation through our website and mobile applications, measure received visits, analyze the use made of the portal and all its functionalities, manage our advertising, offer you personalized content and advertising spaces, as well as perform anonymous statistical reports, analysis, selection, and customer segmentation regarding access habits and activity developed by users in our online store. To obtain more information on how we will use data collected through cookies, you can consult our Cookies Policy below. |
|

Are you required to provide the data we request?
When the legal basis legitimizing us to process your data is your own consent, as a general rule, you will not be required to provide us with your personal data. However, please bear in mind that we will only be able to provide the services you request or give you access to certain functionalities if you provide us with some data we consider necessary for such purposes, which you can clearly identify in our forms because they are marked with an asterisk (*).
If you do not provide us with this required data, we probably cannot provide the requested services or will have to provide them incompletely. For example, if you make a request through our contact form, register as a registered user, or subscribe to our newsletter, you must at least provide us with your name and email address, otherwise, we will not be able to answer your query, create your personal account, or send you the newsletters, respectively.
In any case, your consent must be free, specific, informed, and unambiguous, and you must grant it through a positive and affirmative action, without any pressure and knowing what you are consenting to. That is why at NIFTY LASH we advocate for maximum transparency, and when requesting your consent through the corresponding forms, we will include a summary with basic data protection information, a link to this Privacy Policy, and a box that you must expressly check to consent to the processing in question. We recommend that you read all this information before giving your consent to each type of processing. We will keep a record of all consents you have given in this regard.
Is it possible to withdraw your consent?
Of course. In cases where you have authorized us to process your personal information, you can withdraw your consent at any time by contacting us and indicating specifically for which treatments or purposes you wish to withdraw consent. You can do this by writing to our postal address, through the contact form on our website, or by email at info@beautylash.es. We may ask for a copy of your ID to properly identify you. Please note that the withdrawal of your consent does not affect the legality of the data processing subject to your consent that we performed before said withdrawal, nor the data processing we may perform on other legal bases, such as a legitimate interest, the execution of a contract, or compliance with a legal obligation.
RECIPIENTS
To which recipients will your data be communicated?
All data you have provided to us will be treated by NIFTY LASH with the utmost confidentiality. Sometimes, to fulfill the purposes indicated in this Privacy Policy, we need to give access to your personal data to other service providers who support us in the services we offer you. These are trusted third parties who will only have access to your data for the ultimate purpose of enabling us to provide the requested services under the best conditions.
Where appropriate, and always in accordance with current legislation, we may exchange your personal data with the following categories of recipients:
- With service providers who perform specific functions for NIFTY LASH. This category includes, for example, the following:
- Transport or logistics companies that manage the shipment of orders to our customers, as well as exchanges and returns;
- Companies or professionals who help us provide technological or digital strategy services, such as web developers or platform providers, hosting services, maintenance, and support for our databases, software, and applications.
- Accounting or administrative managers;
- External consultants, lawyers, and auditors;
- Banking entities responsible for our website's payment gateway and companies certifying secure payment in online environments and mobile applications;
- Facebook Messenger subscriber management companies
NIFTY LASH has signed the corresponding Data Processing Agreement with each of the external providers to whom we communicate personal data of our customers and users so that they can only process them according to our instructions and for strictly necessary purposes.
In the event that, to provide our services to you, it is necessary to transfer your data to companies outside the European Economic Area (EEA), we will only work with companies that offer sufficient privacy protection in accordance with European legislation, such as, for example, service providers located in the United States or other countries that adhere to the “Privacy Shield” (www.privacyshield.gov), or companies with which we have signed standard contractual clauses approved by the European Commission.
- With public administrations or public and private entities such as judicial bodies, tax authorities, police forces, fraud prevention and debt collection agencies, etc., in the event that by legal imperative or due to our legitimate interests, we are obliged to share certain information with them (for example, in case of litigation or in response to a request from a tax authority).
Will your data be transferred to third countries?
We will only communicate your data to recipients established in countries outside the European Economic Area (European Union countries plus Liechtenstein, Iceland, and Norway) if it is strictly necessary to provide the services requested or contracted, for example, when some of our suppliers mentioned in the previous section are located in third countries.
In these cases, all international data transfers will be carried out in strict compliance with all guarantees required by European legislation. That is, we will only communicate them to providers who adhere to the Privacy Shield, or through the use and signing of standard contractual clauses approved by the European Commission.
RIGHTS
What are your rights when you provide us with your data?
First, you have the right to obtain confirmation as to whether or not NIFTY LASH is processing personal data concerning you. And in the event that we are processing your personal data, you have the following rights:
- Right of access: You have the right to access your personal data. In the event that we are processing your data, you can ask us for the following information: what that data is; for what purposes we are processing it; possible communications, assignments, or transfers of your data to third parties; expected retention period; your right to request rectification or erasure of your personal data or limitation of its processing, or to object to said processing; the right to lodge a complaint with the supervisory authority; in the event that personal data was not obtained from you, any available information about its origin; the existence of automated decisions, including profiling, and meaningful information about the logic involved, as well as the significance and envisaged consequences of such processing for you.
- Right of rectification: You have the right to obtain the rectification of inaccurate or incomplete personal data concerning you, for example, in case of errors, spelling mistakes, changes in collected data, etc. If we had shared your personal data with third parties, we will urge them to rectify it as you have indicated to us, unless it is impossible or involves disproportionate effort. Where appropriate, we will also inform you to which third parties we have provided your inaccurate or incomplete personal data.
- Right of erasure ("right to be forgotten"): In certain circumstances, you have the right to request that we delete or permanently remove your personal data when, for example, they are no longer relevant or necessary in relation to the purposes for which they were collected or otherwise processed, when you withdraw the consent on which the processing of your data is based (unless there is another legal basis for its processing), when you have objected to the processing of your data and no other legitimate grounds for processing prevail, etc.
- Right to object: You can object at any time, for reasons related to your particular situation, to your personal data being processed based on the satisfaction of our legitimate interests. In these cases, we will heed your objection request and stop processing your personal data, unless there are compelling legitimate grounds for the processing that override the interests, rights, and freedoms you may have cited, or for the establishment, exercise, or defense of legal claims.
- Right not to be subject to automated individual decisions: You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This right will be excepted if you have given us your explicit consent or if said decision is necessary for entering into or performing a contract with you.
- Right to data portability: It is an advanced form of the right of access and means that you can ask us to send you a copy of your data in a structured, commonly used, and machine-readable format (for example, on a data CD). You can exercise this right in three cases: (i) When processing is carried out by automated means, i.e., without human intervention; (ii) When processing is based on your prior consent or a contract; (iii) When you request it regarding data you have provided to us and that concerns you, including data derived from your own activity. The right to portability also implies that you can ask us to send your personal data to another data controller on your behalf, without us having to send them to you first, provided this is technically feasible.
- Right to restriction of processing: You can ask us not to apply the processing operations that would correspond in each case to your personal data. In other words, we can only continue to store them, but we cannot perform any other processing activity until certain circumstances arise. By way of example, you can request the restriction of your data when you have exercised the rights of rectification or objection (while we are verifying the accuracy of your data or our legitimate reasons for processing them), or when the erasure of your data is appropriate but you prefer that we limit the processing instead of deleting them completely. When the processing of your personal data has been restricted, we may only process them (except for storage) with your prior consent or for the establishment, exercise, or defense of legal claims.
- Right to withdraw consent given: In the event that you had granted consent for a specific purpose, such as authorizing us to send you advertising about our products and services, you have the right to withdraw said consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.
- Right to lodge a complaint with the Supervisory Authority: If you consider that your rights have been violated and that the processing of your personal data is contrary to the provisions of the General Data Protection Regulation, you have the right to lodge a complaint with the supervisory authority of your country, without prejudice to any other administrative appeal or judicial action you may file. In Spain, you can exercise this right by contacting the following supervisory authority:
Name: Agencia Española de Protección de Datos (Spanish Data Protection Agency)
Postal Address: C/ Jorge Juan, 6. 28001, Madrid (Spain)
Phone(s): +34 901 100 099 / +34 912 663 517
Website: www.agpd.es
If you reside outside Spain, you can also contact the competent data protection authority in your country.
How can you exercise your rights?
We have forms available for you to exercise all rights mentioned above quickly, free of charge, and simply. You just have to request the form in question and return it filled out via our email address info@beautylash.es, attaching a copy of your national identity document. Once your request is received, you will receive our response within a maximum period of one month.

Security measures may vary depending on the characteristics of the processing, the type of data processed, or the technology available at any given time. We apply appropriate technical and organizational measures to guarantee a level of security appropriate to the risk, taking into account the risks presented by data processing as a consequence of accidental or unlawful destruction, loss, or alteration of personal data transmitted, stored, or otherwise processed, or unauthorized communication or access to such data.
Our website is stored on secure servers protected against the most common types of attacks. Notwithstanding the foregoing, technical security in a medium like the Internet is not impregnable, and malicious acts by third parties may exist, although NIFTY LASH puts all means at its disposal to prevent such actions.
If you suspect that misuse of your personal data or unauthorized access to it may be occurring, please let us know immediately so we can take action. You can write to us at our email address info@beautylash.es or through the customer service channels available on our website.
